Preamble

The French Escape — by Château des Vigiers

The French Escape — by Château des Vigiers is a range of stays created, marketed and organised directly by SA Château des Vigiers.

The French Escape does not constitute a separate company or legal entity. It is a trading name used by Château des Vigiers to present and market a selection of stays combining accommodation, gastronomy, vineyard discovery, golf and other tourism experiences.

Accordingly, any enquiry, proposal, booking or contract made under the name The French Escape is concluded with SA Château des Vigiers.

These Terms and Conditions of Sale, hereinafter referred to as the “Terms”, set out the conditions applicable to stays marketed under The French Escape brand.

Article 1

Purpose and scope

These Terms apply in particular to The French Wine Escape and The French Wine & Golf Escape stays, as well as to any additional days, nights or services added to those stays.

The precise features of the stay, its dates, price and included services are specified in the personalised proposal sent to the client before any final booking.

This personalised proposal supplements these Terms. Where a specific provision is expressly stated in the proposal, that provision shall prevail for the stay concerned.

Given that accommodation is combined with tourism services forming an essential feature of the stay, The French Escape offers may fall within the package travel regime provided for by the French Tourism Code.

Article 2

Capacity and persons participating in the stay

The client declares that they have the legal capacity required to enter into the contract.

Where one person books on behalf of several participants, that person declares that they are authorised to act on their behalf and undertakes to communicate to them all information and conditions relating to the stay.

The client is responsible for the accuracy of the information provided when making an enquiry and booking.

Article 3

Stay enquiry and booking process

The “Plan your escape” form available on The French Escape website allows the client to submit a stay enquiry.

Submitting this enquiry:

• does not constitute a booking;
• does not guarantee the availability of the services;
• does not create any obligation to pay.

Upon receipt of the enquiry, the Château des Vigiers team checks, in particular, the availability of the accommodation, requested services and experiences, as well as the availability of any service providers involved during the stay.

Following these checks, Château des Vigiers may send the client a personalised proposal specifying, in particular, the programme, dates, number of participants, included services and price of the stay.

The client indicating that they wish to proceed with the booking does not, in itself, constitute final confirmation of the stay.

The booking becomes firm once the required payment or deposit has been received and Château des Vigiers has issued final written confirmation.

Article 4

Services included in the stay

Only services expressly mentioned in the personalised proposal are included in the price.

Depending on the stay selected, these may include:

• accommodation at Château des Vigiers;
• breakfasts;
• certain dinners;
• guided days in the vineyards of Bergerac or Saint-Émilion;
• the tastings included in the programme;
• certain lunches or picnics;
• transport during certain guided days;
• green fees and golf days where included in the stay;
• any additional days or nights expressly added to the booking.

The exact order of the programme may be adapted where operational constraints or service-provider availability require it, provided that the nature and overall quality of the stay are preserved.

Article 5

Services not included

Unless expressly stated otherwise, the following are not included:

• air tickets;
• train tickets;
• transport to Château des Vigiers;
• private transfers to or from an airport or railway station;
• personal purchases or services not provided for;
• optional activities not listed in the proposal;
• personal insurance and travel insurance;
• any other service not expressly mentioned.

At the client’s request, Château des Vigiers may assist in arranging certain additional services, including transfers.

Article 6

Price

Prices are stated in euros, inclusive of taxes where applicable.

The price applicable to the stay is the price stated in the personalised proposal sent to the client.

Any prices displayed on the website are indicative or “from” prices and do not constitute a firm offer until availability and the exact configuration of the stay have been checked.

Any additional services requested after the proposal has been issued may result in a change to the price.

Tourist tax and any supplements not included in the price will be specified to the client where applicable.

Article 7

Payment

The payment terms applicable to the stay are specified in the personalised proposal and/or when the booking is confirmed.

The booking is only definitively guaranteed once the required sums have been received and Château des Vigiers has issued written confirmation.

Article 8

Changes requested by the client

Any request to change the dates, number of participants, programme or options must be submitted to Château des Vigiers.

Changes are subject to availability, the possibilities of the service providers concerned and, where applicable, a price adjustment.

A change request is only considered accepted once Château des Vigiers has confirmed it in writing.

Article 9

Transfer of the booking à une autre personne

Under the conditions provided for by the regulations applicable to package travel, the traveller may transfer the contract to another person who meets the same conditions for taking the stay.

The client must inform Château des Vigiers within a reasonable period before the start of the stay.

Any additional costs actually incurred as a result of the transfer may be charged in accordance with the applicable regulations.

Article 10

Cancellation by the client

The client may cancel the stay before it begins. Cancellation charges may, however, apply depending on the date on which the cancellation occurs, in particular to take account of services already booked with the hotel and external service providers.

The applicable cancellation schedule must be communicated to the client before final confirmation of the booking.

Where extraordinary and unavoidable circumstances occurring at the destination or in its immediate vicinity significantly affect the performance of the stay, the client retains the rights provided for by the French Tourism Code.

Article 11

Changes or cancellation by Château des Vigiers

Château des Vigiers organises the stays in cooperation with various local partners and service providers.

If a service unexpectedly becomes unavailable, Château des Vigiers may, where possible, propose a change of schedule, a change in the order of activities or a replacement experience of comparable standard and interest.

Where a substantial change to the stay becomes necessary before departure, the client will be informed as soon as possible and will benefit from the rights provided for by applicable law.

Where Château des Vigiers sells a package travel arrangement, it remains responsible for the proper performance of the services provided for in the contract, including where certain services are performed by external partners.

Article 12

Extraordinary circumstances et inévitables

In the event of extraordinary and unavoidable circumstances preventing or significantly affecting the performance of the stay, the parties shall be subject to the applicable legal provisions.

Château des Vigiers will inform the client as soon as possible and, where reasonably possible, seek a solution allowing the stay to be adapted or continued.

Article 13

Right of withdrawal

Accommodation, catering and leisure services provided on a specific date or during a specific period do not benefit from the fourteen-day right of withdrawal applicable to certain distance sales, in accordance in particular with Article L.221-28, 12° of the French Consumer Code.

The applicable cancellation conditions are therefore those defined in these Terms and in the personalised proposal, subject to the specific rights provided for by the French Tourism Code.

Article 14

Accommodation at Château des Vigiers

Rooms are normally available from 3:00 p.m. on the day of arrival.

On the day of departure, rooms must normally be vacated before 12:00 noon, unless otherwise agreed.

The client and participants must comply with the establishment’s internal rules and behave respectfully towards other guests, staff, equipment and facilities.

Article 15

Golf

For stays including golf, participants are subject to the rules and access conditions of Golf des Vigiers in force during their stay.

Tee times are arranged or booked subject to availability.

Course conditions, buggy use and certain playing conditions may be adapted or restricted due to weather conditions or safety requirements.

Article 16

Wine-related services et dégustations

Visits and tastings are organised subject to the availability of partner estates and producers.

The estates visited may vary from one stay to another in order to preserve the quality of the experience and take account of constraints associated with wine production.

Alcohol tastings are reserved for persons who have reached the legal drinking age.

Consumption of alcohol is never compulsory. Alternatives may be offered where possible.

Article 17

Liability

Château des Vigiers is responsible for the performance of the services included in the contract in accordance with applicable regulations.

The client remains responsible for:

• their personal belongings;
• complying with safety instructions;
• their conduct during the stay;
• any damage they may cause;
• holding the administrative documents required for travel to France;
• their personal ability to participate in the chosen activities.

Flights and transport to Château des Vigiers that are not sold as part of the stay remain the responsibility of the client and the relevant carriers.

Article 18

Travel insurance

Château des Vigiers recommends that participants hold suitable personal insurance covering, in particular, cancellation of the stay, travel incidents, medical expenses, repatriation and any sporting activities undertaken.

Article 19

Complaints

Any difficulty encountered during the stay must be reported to the Château des Vigiers team as soon as possible so that, where possible, a solution can be provided during the stay.

Any subsequent complaint may be sent to SA Château des Vigiers, 644 Route Lars Urban Petersson, Lieu-dit Le Vigier, 24240 Monestier – France, or by email to the contact address provided to the client.

Article 20

Protection of personal data

Data provided in connection with an enquiry or booking are processed by Château des Vigiers for the purpose of organising and providing the stay.

Certain strictly necessary information may be shared with service providers involved in the performance of the stay, for example to organise a visit, activity or transfer.

Article 21

Mediation

After first contacting Château des Vigiers and in the absence of a satisfactory resolution of the dispute, the consumer may refer the matter to the French Tourism and Travel Mediator.

Article 22

Applicable law

These Terms and Conditions of Sale are governed by French law, subject to any mandatory consumer-protection provisions that may apply in the consumer’s country of residence.
